Why Sex During Periods is Not Haram in Islam
C.J Ahmed-20.05.2023
Having sex during periods is not haram and it is based on the following hadiths,
Aishah said: “If one of us was menstruating and the Messenger of Allah (peace and blessings of Allah be upon him) wanted to be intimate with her, he would tell her to wear an izar (waist wrapper) at the peak of her menstruation, then he would be intimate with her.” (Bukhari and Muslim)
Narrated One of the Wives of the Prophet:
Ikrimah reported on the authority of one of the wives of the Prophet (sal) saying: When the Prophet (sal) wanted to do something with (his) menstruating wife, he would put a garment on her private part.(bu Dawud-Graded Sahih by Albani)
Some try to use the below verse to forbid sex while menstruating.
“They ask you concerning menstruation. Say: that is an adha, therefore, keep away from women during menses and go not unto them till they are purified”(Al-Quran-2:222)
The context of the verse is explained in the following hdith,
Anas b. malik said:
Among the jews, when a women menstruated, they ejected her from the house, and they did not eat with her, nor did they drink with her, nor did they associate with her in (their houses) so the Messenger of Allah (May peace be upon him) was questioned about that. Thereupon Allah revealed : “They question thee concerning menstruation. Say : I: is an illness, so let woman alone at such times” (ii 222). The Messenger of Allah (May peace be upon him) then said: Associate with them in the houses and do everything except sexual intercourse. Thereupon the Jews said: This man does not want to leave anything we do without opposing us in it. Usaid b. Hudair and Abbad b. Bishr came and said: Messenger of Allah, the jews are saying such and such a thing. Shall we not then have intercourse with women during mensuration? The face of the Apostle Allah(sal) underwent such a change that we thought he was angry with them; but when they went out they received a gift of milk which was being brought to the Messenger of Allah(sal), and he sent after them and gave them a drink, whereupon we thought that he was not angry with them. (Abu Dawud-Graded Sahih by Albani)
What is meant is that sex is allowed while menstruating except entering the penis inside the vagina but under necessity, intercourse is also halal while menstruating.
This is how Allah(Swt) explains the principal of necessity.
"And why should you not eat of that (meat) on which Allah’s Name has been pronounced (at the time of slaughtering the animal), while He has explained to you in detail what is forbidden to you, except under compulsion of necessity?”
(Al-Quran-6:119)
And
"He has only forbidden you carrion, blood, and swine, and that which has been consecrated to any other than Allah. But who is driven by necessity, neither craving nor transgressing, it is no sin for him. For Allah is Forgiving, Compassionate."
(Al-Quran-2:173)
"Narrated Anas (Rali):
The Prophet (sal) allowed `Abdur-Rahman bin `Auf and Az-Zubair bin Al-`Awwam to wear silk because they were suffering from an itch" .
(Sahih Al Bukhari)
In this hadith, the prophet(Sal) allowed Abdur Rahman bin auf and Zubair bin Awwam to wear silk because they had an itch. Generally wearing silk is haram for men except for embroidery or in a small amount but the prophet (Sal) allowed silk for the two companions. due to a reason.
